IndyMac Bank has implemented a systematic loan modification program for troubled borrowers. The new Indymac loan modification program is designed to achieve affordable and sustainable loan payments. What loans are eligible for the IndyMac loan modification program? To reach this ratio, loan modifications could include a combination of interest rate reductions, longer terms and principal forebearance. If necessary, IndyMac loan modification offers will include a further interest rate reduction for the first five years, and after that time, the interest rate increase would be capped at 1% per year until at Freddie Mac survey rate, where it will remain for the life of the loan.
How does a borrower qualify for an IndyMac loan modification? The borrower must provide the bank with income documentation to determine what loan modification is necessary to reach the 38% debt to income ratio. To reach this 38% ratio, the loan modification may adopt a combination of interest rate reduction, extended amortization and principal forebearance.
How do borrowers apply for this IndyMac loan modification? Thousands of delinquent borrowers will be receiving loan modification offers by mail. These offers are based on current income information provided by the borrowers. Once a borrower has provided financial information to an IndyMac customer service representative, the lender will evaluate whether a loan modification may be available. What happens after the borrower receives the IndyMac loan modification offer? Just signed escrow pappers on a new home and the loan was set at a douable figure that we could afford as we are senior citizens and then the bank sent us a payment of over one hundred dollers more than was aggreed on at escrow. Now what can we do ?

We finished construction of our log home in October of 08 and ended up with a high interest rate loan. We were told it was beaause we went over the 12 month construction period. Then we were advised and proceded with a “Pilot Program” to get a revised loan to help us financially to keep our new-built log home. We were told by Virginia Barger that we were approved in about December or January. All this time we have been emailing her back and forth, then also Nathan Carter was supposidley in charge of the new revised loans and we were told ours was “on the list”. Yesterday, April 13th, we were told by another Indymac associate that we were actually declined on that program last February. No contacted us about this nor was it mentioned in the email to Virginia Barger.
We have been through so much with this whole loan process during our construction, in which Indymac went bankrupt last July during our construction . We’ve used all our savings and 401Ks to finish our home. During the last few months of construction, no one at Indymac would give us an idea of what our interest was going to be, so it was very shocking to get the high interest rate in the end. With a better interest rate that you are now giving out, we could much more easily afford our payment..
Yesterday my husband filled out a new loan modification form package and mailed it to hopefully restucture our loan. We are, at this point, praying for an affordable interest rate .

i have been trying to get a loan modification with indymac since Feb 2009. They put me on a temporary modification in Feb. I had 3 months of paying a lower mortgage, They told me that it would take 30 to 60 days for the modification to be final. It is now May 5th. My ortgage went back up to the $3400.00 per month. They told me they didn’t know how much longer it would take to get the loan modification. I also sent in the hardship package and they are stating they can’t pull up the image. They are not very helpful at all. I do not know what to do. I am 30 days from foreclosure.

I have been requesting mod info/help from Indy since 2/2009. They alway said “you should be receiving something in the mail” We never did, we called again, same thing. Did this for a few months. Finally they offered the loan mod packet download on their website & said any requests previously were null & void. Faxed loan mod packet 5/8/09 – made a few follow up calls to verify it was rec’d. Get a run around & was told same as others – these items are not imaged into their system, so they have no idea if they got it!!!!!!! But it takes 30-60 days to receive a loan mod offer in the mail once they do process info.
I guess I keep bugging them!

I sent Indy Mac the loan mod packet through the mail and they said they received it and were transfering me to the mod dept when my call got dropped. I called back and then they told me all they had received was my pay stubs and they weren’t allowed to transfer anyone to that dept because of the high call volume I was told to resend everything if I wanted to. Sounds to me like everyone is getting the run around.

I have been trying to get a loan modification since November 2008 from Indymac. I’ve been getting the run around. I am a self employed realtor and my income has been drastically impacted because of the housing market. Lower priced homes means lower commissions for me….and thats when I get a commission. Indymac rejected my paycheck stubs because they are commision checks. So I faxed in my profit and loss statements. Now they are saying its going to take an additional 30-60 days and there is no guarantee my loan will be modified. I am already 30 days behind. I’m so nervous and afraid. I am a divorced single mom with two kids. Our home is all we have. Does anyone know how to reach someone higher up at Indymac? Those customer service people are rude and of no service. I had one guy T.J. actually hang up on me because I questioned Indymac’s policy. Please help, anybody!!!

It iappears that I am not the only customer who is receiving little-to-no support. I mailed my loan modification package with all required documents in mid-April. I made a follow-up call in early July. I was told they had no record of receiving my package. I was told to re-submit the package via fax. I did so within 30 minutes. Based on other blogs, I have little confidence that I will be serviced anytime soon.

Indy Mac Modification, is a joke, when you call and go over your finances, they ask you all this information and they can see the problems your having, and you want to continue to try and pay however you can! Indy Mac come up “call this number for this program and this number and this number” they take the same information, but time after time you don’t qualfiy but you can’t pay your mortgage. Then who in the HELL can?
you know this is a mess, if I paid you all these years and I just want you to lower the damn rate or give me a fixed rate that’s affordable. WHAT’S THE PROBLEM GUY’S

I sent my loan modification application via fax mid May. By the end of June I called to follow up on my application. They said the never received the fax . I had to fax my application again. I called them back , this time they did receive it. Now I have to wait 60 days for them to review it.
Have they helped anyone ?

applied for the modification in Mar09, completed the online pack and forms. Sent them via fax and pay stubs. Followed up via phone a few days later. No record of recieving the docs. I refaxed again. Got a letter in may09 from Brandon Latman VP indymac stating I would hear from them in 14 days. Another month passed, followed up again via phone call, girl had no clue asked me to refax the pack. I did got another letter in Jun09 stating I’ll hear something in 30 days again from Mr Latman. It’s now Aug09 and im on the phone to them again chasing a reply. Nothing seems so be happening.

Applied for IndyMac loan mod program on July 16; Current payments 1356 per month, Loan orgination date Nov 2007 of 223,000, our current balance is 170,000 at 6.65%. Base on the amount of money we have put towards the loan you think we would be ideal for the mod. But based on me losing my job and my wifes income IndyMac is jerking our chain. If they lower our interest rate to 4.75% for 30 years our payments would be 886.00 per month. We cut off cable, internet, limit of food consumption, no credit cards to lower our debt to income ratio to 38%….. STAY TUNED

We are $100,000+ upside down on our house, we have made MANY calls to Indymac and have asked them PLEASE help we are having PROBLEMS making our $2,000 a month house payment. And they have ALWAYS said NO we can NOT help you, they said we could lower your payment by a few dollars a month, but they will roll what we dont pay right back into the loan. The house is not worth $265,000 anymore. No houses are worth anything where I live. I feel IndyMac people dont care about their custumers. We have been in our home for almost 15 years and I’m afraid we will lose our home. Well good luck to all that is with IndyMac.

I started a modification in November 2008 and was denied. I then tried under the Obama plan & received a letter from Brandon Latman June 26 saying I’d have an answer in 30 days. Now it is the first of September & still no answer. How long do we have to wait for an answer?

IndyMac Is only here t collect money from each and every one of us suckers who wound up with this money hungry, glutt filling, crooked ass bank. I purchased my house two years ago and my loan was sold to this bank from another institution that went belly up, I should have known then that this was a trap. I’m a man and by no way is this any disrespect to the President but this mortage crisis intervention is bullshit…. IndyMac ain’t helping nobody but IndyMac, if there was any help our there for home borrowers: “YES, that’s what we are because we will never own these homes due to the high ass interest rates we have been locked into since the crash of the housing market. OBAMA LIE to us some more while you enjoy your vacations and ski trips…. Who do you say you represent? The People, I guess overseas. I hope everyone just decides to turn in their keys to their homes at the same time and fuck this bank up. Lets all come together and make September the last month we all pay on our mortgages and bankrupt these bitches. I currently work for indymac in a call center and I just have to say that the loan modification process takes 30-60-90-even 120 days to complete. BE PATIENT…..you will get a answer sent to you in the mail….It does take some time but just keep calling for updates! O Another thing when calling to check updates please do not yell, scream, or curse the reps, neither them or any onsite supervisors can speed up the process! THANK YOU!

We received a loan modification offer on July 8, 2009, signed Brandon Latman and received confirmation that our documents had been received on July 29th. We were told they expected a decision by September 12. We also received notification that unless arrangements were made by September 12, foreclosure proceedings would begin. On the contract they offered us, that we accepted, it states as long as we make payments in the amount stated in the Loan Modification, while the application is active, foreclosure proceedings would not begin. It states the same thing on the FDIC website under IndyMac. We made the payment as directed by the Mod and will continue to make payments as directed, but are still concerned about foreclosure. Has anyone had experience with this? I spoke with an attorney who told me that most likely our mod will be approved because we have a high mortgage balance and typically IndyMac does everything possible not to foreclose on jumbo mortgages if you can afford to make the new payments, which we can.

My attorny said my banks negotiator offerd us apayment of1080 a month the offer was made on sept 1st 2009 and she says i should be getting my packet with all the docs but its oct 02 2009 and i havent received anything yet and my house is going to be sold on oct 13 2009 i ask her about this and she told me that the cant sell my house because we have already came to an agreement that the bank still has to go thru the process but not to worry imnot going to lose my house but i am worried any suggestions

Let’s clog his phone and email until he listens. In addition, lets file reports with the regulators: Office of Thrift Supervision, OCC, and Federal Trade Commission. There has to be some kind of law against so many lost packages with all our financial information. Sound like a servicing issue and a privacy violation to me!

I am in the same boat as everyone here. However, IndyMac sold my house on September 18th and sent me a letter denying my loan modification request on September 29th and another one, for whatever reason, on October 6th! IndyMac is no inclined to work with any one! They give everyone the run-around until you lose hope AND your home. They want their collateral back, they don’t want to help anyone. In their denial letter, they state that my loan will continue to be serviced by them but they fail to tell me that the house has sold. What a joke! I have been trying to work out a loan modification since May, 2009, and had a lawyer helping me! My lawyer is baffled! She contacted their legal department who in turn told her that there is no record of me trying to get a loan modification. This is the only case that she has encountered where a bank won’t work with you. Seems like us IndyMac borrowers, got screwed big time and all the while they claim WE ARE HERE TO HELP? What about all the people whose money were lost while banking with IndyMac Federal bank, whose funds were not FDIC insured, what is going on here! deception deception deception. When is the government going to take notice of this! We bailed their behinds out and now they are not inclined to lift a finger to help those who need loan modifications. Class action suit is what I say!

Response to Denise’s comment. They will sell your house. Initially, I had a sale date of 8/18/09 even though my documents were submitted several times. My attorney spoke to the Trustee and IndyMac was able to pull the house from the sale pending review of my loan modification docs. She even sent them a letter confirming this. After I received my denial letter on September 29th, my attorney contacted them to inquire why it was denied and they told her that the property was sold on 9/18/09. No notice of this sale was ever received by my atty or myself. They are not helping anyone as evidenced by all these angry blogs.

IndyMac Vice President, Brandon Latman, is sitting on his desk modifying his template letter of denial to be addressed to everyone requesting a loan modification. I got behind in payments in Nov. 08 and applied for loan mod in Jan 09. Received a loan mod package, Signed in front of notary and sent cashiers check, all requested financial info and overnight before the deadline. They acknowledge receiving it in time. They sent the check back with a letter saying it was the incorrect amount and denied the modification. CSR stated they pulled that program and wouldn’t honor the modification. 2 weeks later they offered a forbearance for 6 months with a 3000 payment. Again I signed and wired 3000.00 as they requested to where they requested. ( day before sale) They again sent back the 3000.00 and wouldn’t honor the forbearance. They pulled it from sale though and again sent a package to apply for modification in May. They refused any payments and refused the modification sept 15. 09. stating that they don’t do property’s not owner occupied. ( they new that in May as I rented it to help make payment and moved in with relatives.) In Louisiana they are entitled to a 25% deficiency judgement and the property. So I sued them and got a little more time (sale dec 3, 09) Indymac’s foreclosure attorney turns out to be nice and is involved in cutting through the bureaucracy. Bank one got a sweetheart deal in April when they acquired indymac and absolutely crooked and deceitful. I am pretty sure I will lose the house but hope to prevent the 25% judgement. Meanwhile l Requested Documents to see if they complied with RESPA and TILA requirements.

After reviewing all of the comments above, it sounds that they are not willing to help anyone. However, I called a dept. named Project Lifeline. Now, these people are only advisors and they tell you basically what I already knew. However, they were quite people friendly even though I asked the same questions over and over until I got the meaning. I just hope I dont end up in the street as a basket pusher or some hobo. I want to stay here but when I called Indymac last Friday the lady who answered kept asking when could I pay the last two payments on my acct. that were past due. She seemed rude, stressed and I felt I was being rushed off the phone. She kept saying, “anything else”? Finally, I got dial tone.
I have all these documents filled out, very painstaking but hey, what the heck. I just hope everyone here gets the help they need. Also, I emailed Brandon Latman. Good thing I got the email from Eval Torres….Brandon’s email is brandon.latman@indymacbank.com

I have been having nothing but negative results with Indymac. Last year I was completing my construction loan and it was rolled over to a regular loan durring the Indymac crisis that same week. Unfortunately they gave me almost a 10 percent interest rate and told me that I had no choice. Hard economic times were also starting for me and several months later I was mailed a loan modificatin offer with out me asking for one. I completed everything in the package including a cashiers check for over 6,000. They credited the amount to my account balance and then I never recieved anything stating that they approved me. In december indymac was holding a massive event offering to modify loans. I took everything in and resubmited my package with a regional manager that was there. She said that it was unclear on why they denied my modification. Months later I go a letter just stating that I did not qualify for for a modification. No explanations were given. I resubmitted again and then waited and waited and another denial letter came in with no explanation. I resubmitted again and I gave preasure to the regional manager. She finaly came back and said that they refused to modify my loan. No reason again. She said sell your home because your loan is not modifyable.
They then stared forclosure proceedings and I called them about a month ago and they told me that they are no longer modifying jumbo loans over $729,000. I whent to their website and the website confirmed it in red letters. Today I could not sleep and have been online since 3am and I decided to go into their website and Wow they removed the guideline. I am waiting till they open so I can call and get a package sent over if they are now considering large modifications. My sale date is on November the 5th I have less than 8 working days to stop the sale of my home and do a modification. I pray to God that I get the strength to completed this. I thank my saint Saint Jude for helping me accomplish this great success.

I am fed up with Indymac not wanting to help people. My husband is a self employed mechanic and I lost my job in July. My husband has been hit hard by the recent economy failure and the cash for clunkers program. I am getting unemployment, but we are barely able to make a monthly payment for our mortgage. We sent in our application for the Home Affordable Modfication Program in August 2009. They received it and said it would be processes in 30-60 days. I waited until October to call them and they told me they were still reviewing it. I called on November 2 and was told that we were denied. I asked why and could not receive a clear answer. I asked why we didn’t receive a denial letter. She said the denial letter was sent on October 16. We decided to let it go until we received another application in the mail for the same program we already applied for. Confused…..we called them again. This time I spoke with a girl who said we were not denied. There was no denial letter (which is why we didn’t get one in the first place). She said that our application expires after 60 days. We have to fill another one out and start completely over. I am so angry and upset because its not our fault that they were too slow in processing our application in a timely manner. Now we have to suffer because of their poor process. My advice to anyone considering getting a loan with Indymac…….DO NOT DO IT. They are rude on the phone and have poor customer service skills. They are giving everyone who needs help the runaround. We contacted our Senator and even sent a letter to the president of the U.S. Maybe if more people contact them, they will do something about it.
PS: I see where an Indymac CSR states that the loan modification takes 30-60-90-120 days……how can it be more than 60 when I was told our application expires after 60 days? They obviously don’t know what they are doing.

I have been trynig to get a modifcation or ANY kind of help from Indymac since December of last year. I have sent 2 complete packages of paperwork in and the first time I was told there was nothing they could do. After the second package, every time I called to check status, they would tell me I needed another piece of paperwork…every single time I had called. Now I am trying for my 3rd time to get some help! It’s been just about a year of trying to work with them and when I called just now to try to get status, I was told their system was down….

Wow. Just looked at IndyMac’s website today to find out about a loan modification, as I am having trouble making my mortgage payments. Now I’m really discouraged. I don’t think I’ll even bother after reading these comments. What a shame. I’m going to try to refinance with someone else, but I know it won’t be easy. Yeah, somebody mentioned a class action lawsuit against IndyMac; sounds good to me. Have they ever heard of the Business and Professions Code? It’s almost sinful what they’re doing. (or I should say NOT doing) Hang in there, people.

I TRYED TO GET LOAN MODIFICATION FOR LAST 2 YEARS NOW THRU THE INTERNET,WHICH I THOUGHT THEY WERE GOOD LAWYERS FIRMS AND HONEST PEOPLE. THEY TOLD US NOT TO TALK TO OUR LENDERS. THEY WILL TALK TO THEM FOR US. WE BELIEVE THEM. I FOUND OUT AFTER THEY TOOK MY MONEY. i TRIED TO CALL THEM TO SEE ABOUT MY LOAN. THERE PHONE WAS DISCONNECTED. I THOUGHT THEY WERE ALL SCAMMERS. NOW IT IS HARD TO MAKE MY MORTGAGE PAYMENTS. THEN WE WERE GETTING LETTERS SAYING YOU NEED TO PAY THE REGULAR PAYMENTS OR WE WILL FORECLOSURE ON YOUR HOUSE. WHILE I WAS MAKING PARTIAL PAYMENTS TO TRY TO SAVE MY HOME. YOU KEPT SENDING THE SAME LETTERS SO I THOUGHT YOU WERE GOING FORECLOSURE ON US ANY WAY WHY PAY. I COULD SAVE THE MONEY TO CATCH UP WITH OTHER PAYMENTS I WAS BEHIND IN. AFTER MY HOURS WAS CUT DOWN TO 26 TO 32 HOURS A WEEK. I ‘d like to hear about anyone starting the class action suit. I had been following up with IndyMac every week and they never mentioned a sale date. Well it came in the mail and the people at IndyMac didn’t even know about it and said i was still in review. Now it’s official. Dec. 7. Forced to file BK.
Any suggestions or help would be great.

I have been attempting to get a loan modification since June of 2008. Indymac Services are no longer credible. One of their phone answering teenagers told me that it is all a farce. There are so many calls daily that they can’t handle the load, so each employee makes up their own way of handling the situation. They are allowed to say almoist anything to get rid of the caller (ie…tranfer call to no one, promise a response in 30-60 days, say a file is non-existant, offer to put in a request, trransfer to the loan resolution department or manager which is just another phone person. the list goes on). Don’t expect any positive responses and certainly don’t expect a loan modification. They are a collection agency trying to get as much out of you as they can before taking your house. They will milk you all they can until you are dry, promising anything and collecting for months or years with no payment to your principle. I have lost my eyesight and have been very ill. I would like to start a class action suit but don’t know to get everyone together. Possibly a meeting place in each state or county???????? Any suggestions? Divided we will lose our houses while giving billions to BAILOUT THE SAME BANKS!

My husband and I just did got back our 3rd rejection letter. Everyone here is right about Indymac not doing a thing to help us out. Our load is backed by Fannie Mae who is suppose to be helping out too. But they are not. I am sick and tired of Indymac lack of help, but yet their dept collection agency calls me everyday. I am going to file a grievence with FDIC and HOPE. I am also thinking of doing what the person in Florida did (file a lawsuit against them and get my loan waived free and clear)!

To add insult to injury, not only did Indymac sell my house and denied my loan modification up to four times (probably because of all the loan mod requests I kept submitting that they never “received”) after they sold my house, now that I’ve moved forward with my life, they send me a collections letter for the entire balance of the loan. They are totally screwed up. Not only did they get their collateral back and sold it, now they want me to pay the entire amount of the loan! and I live in California. These people have got their heads so far up their behinds that they don’t know what they’re doing. I am about to write a response to this collection letter.

To add insult to injury you are now trying to collect on a house that YOU took right from under me and my family. I tried for 10 months to get a loan modification from YOU and YOU denied my loan modification request 11 days AFTER YOU sold my house. So, let me get this straight, not only did YOU sell my house and are getting a tax write-off, but now you want me to pay the entire amount of the loan? YOU must be insane. I submitted and resubmitted my loan modification request numerous times and numerous times I was told that the documents were never received time and time again. I received several denial letters to my loan modification requests after my house was sold because each of them responsive to my numerous modification requests submitted and ignored. I would have loved to keep my house and YOU idiots chose not to give me the opportunity to keep it. Instead, YOU imbeciles sold it without even lifting a finger to help me! YOU bet your ass I dispute this debt. Don’t YOU know that this is California? You are barred under the one-action rule. You already sold the house. I would have paid more for the house than what you sold it for. If you would have just reduced the interest on my second it would have been good enough for me to keep-up the loan. But you chose to sell it for pennies on the dollar. I’m sure YOU already know this though and you are merely trying to double dip and rip off someone who YOU hope doesn’t know the law. We just received a letter from IndyMac/One West Bank and the trustee “DEUTSCHE BANK NATIONAL TRUST COMPANY” as the trustee and national servicer of the loan, and required by federal law.
They want us to confirm the balance on the loan.
We are trying to get the loan modified, but have never seen or heard of them sending these letters.
Has anyone else come across a letter like that?
We have 39 days to respond or they will concider that as the actual balance.
According to a previous statement, it was lower. We are confused

what a joke! we have been through the ringer with indy mac as well. since my husband is self- employed we had an 8.5 percent interest rate. tried to refi- of course no one would since we are self-employed. heard about loan mods, indy mac said we have to be 3 months behind to qualify. so we miss 3 payments and applied. twice. this was 6 months ago. in october we got a letter saying they are still trying to figure out what to do with us- in the meantime if we could do a forbearance it will make us look good and we will prob get approved for the mod. so we sign away our rights and start paying 1200 a month in hopes to get a loan mod. then a friend said they saw our house in the paper in foreclosure. we call them and every rep has said something different- one that they never received any packet- others that we were denied- others say to fill it out again they are missing parts- I am calling my senator and filing a complaint with fdic. not that any of it will do any good. I am outraged that they have been bailed out with my tax money and are not helping anyone. we need somewhere we can all join up and make a class action lawsuit plan. if you’re interested email me at mrsvdrake@yahoo.com! lets get a list of complaints going! we can do this! after I compile a list we could get in touch with a great lawyer! i think we have a case!

Incredible! On November 10th Indy Mac cancelled the foreclosure sale on my home and said they would modify my loan. November 24th they said documents would soon be coming. On December 14th they said anyday. December 17th they told me they were Fed Ex-ed that day. December 18th they said I should have them Monday the 21st. December 21st, Indy Mac was surprised I didn’t have them yet and said wait one more day. On December 22nd, they told me that Indy Mac had made a mistake and told many borrowers that they would be getting modifications when in fact they were not and nothing had ever been sent out. They went on to tell me I’d have to wait until my loan was reviewed. They had no time frame for that to be completed. When I pressed them for a date, they “discovered” that ALL my paperwork was missing and that I’d have to fill out new documents before I could even be considered.
This is the fourth time I was told I would be receiving a modification only to have it turn out to not be true. In reading the postings here I am not alone. What can be done about how Indy Mac treats its customers? Can someone please help us? President Obama and our congress, where are you?

YES WE MUST DO CLASS ACTION SUIT…I am in the exact same position as Cristina…We were never told that Deutshe was the trustee of our deed. We were never told that our loan mod wasnt approved. we had to go in to default to discover that. And just this week was told that our loan wasnt approved due to that Deutshe agmt with one west doesnt allow loan mods. 6 months after we initially tried, and were never told this ..and now they are saying it was due to that we didnt qualify and I asked why, they said they dont have to give me a reason. So now we are not sure if we should bring out of default or pray that this new bill gets pushed to force ALL BANKS to modify loans . Any advice on what to do

I am in the same boat as everyone else. Under the trial pay plan have made 2 payments, called on Wednesday to schedule January’s payment and an Indymac CSR wouldn’t accept it and told me that my mod had been denied. When i asked why they said it didn’t fit fannie mae’s model. I still haven’t received a letter and I am terrified that my home will be sold in foreclosure.

I started tried to talk to IndyMac about my situation in Jan. 09, they wouldn’t talk to me about it until I was 3 months delinquent, and I called to say take my house! Then they said “oh you qualify for the Governments affordable housing program and we will be sending you some paperwork. After I got the paperwork, and sent it in, they sent me more paperwork on a Friday that I was to start paying the trial period payments for 3 months and they would give me a final new loan payment if I could do this. I called every month and paid on time. Then they didn’t have an answer, so could I pay the 4th month, which I did, and then called two weeks later, oh we need a profit/loss statement, sent that in and called back a week later, they rejected what I sent, not on the right form, needs to be done by CPA, not my accountant, send in another form. My accountant out of country but got another profit/loss sent in within the week, called on Jan.2 and still had not heard anything. Then they said I was denied on Dec.1st. No one told me, they said I didn’t get the profit and Loss statement in on time. So I am denied, and I have to fill out the paperwork and apply again. No reason and it’s a bunch of BS.
I am ready to file a class action suit. Please contact me if you start that process.
They are so rude to me when I call that I started crying and screaming back the last call.
I too am afraid I will loose my house.

Indy mac sent me the forebearance letter and such and said they would work with me through the process. The last payment was mailed on Jan 8,2010 and on Jan 13, 2010, I got a letter of foreclosure sale for Feb 2, 2010. Talk about a bunch of BS! I complied with all of their demands and when I asked about what was next, I get a letter kicking me out of my house! A class action lawsuit sounds real good to me. Let me know where to sign up at. I will be hand delivering my next set of paperwork that they said to turn in before the foreclosure sale date. Hopefully I will not be going postal if they won’t except the hand delivery. I just want answers as to why they had me make all the payments and do all the paperwork if they were not going to let me keep my house. I had to find a full time job when the market crashed and my business went under because people couldn’t afford to buy anything. Now that there is a steady income, they want to yank the house and what is left of my business out from under me. Some mortgage company! They only wanted bailed out by the government but they sure don’t want to help anyone else. I could be living under a bridge come Feb 2nd.

Eli, I had a lawyer and they still took my house from under me. Thank goodness I did not pay them a dime for 10 months. Yes I got my house taken away, but I saved my money in the process. Indymac will take your money and still sell your house. Just save, save, save! My lawyer was up in arms about Indymac. She does loan modifications and Indymac is the only bank that completely ignored us and gave us the round around like they know how.

I contacted Indymac when the company I worked for over 20 years closed the doors in February. I told them I could make the Feb and March payment but probably not April.I was told there was nothing to be done until I was actually late. So, May 1, 2009 I called and was told to download the loan modification packages and fax them back in. I did that. Indymac kept saying they did not recieve this page, or that page, so I ended up faxing in everything all over and certain pages 6 or 7 times. When Bank One took over in June I was told I had to fax everything all over again! To make this long story short, I have faxed everything Indymac requested at least 6 times! My fax reciepts always say every page went through. I finally got a letter from Indymac saying I did not qualify for a loan mod. I called and asked why, and was given the answer that my income wasnt sufficient! No kidding! If my income hadnt totally been cut in half I wouldnt be in the positon I was in now. Then later that evening I got a call from Indymac wanting another form refaxed so they could work on my modification! Talk about nobody knowing what the heck is going on. I am so disgusted with Indymac!

If you need help with loan modifications go to the HUD website. Loan modification services are free. You should not have to pay for them. On the HUD website you can look up HUD approved centers. HUD approved centers are backed by the Housing Urban and Development Department. It means they’re legit and wont scam you. Plus if you do go to a HUD approved center, it is 50% more likely that you will get some kind of help. And remember, modifications are NOT guaranteed. Most loans are investor held so you cannot go asking for principle reduction, interest rate reduction, etc. What the investor decides is what you get. Another important thing is that once you get an offer and you reject it, you may not get another offer or you’ll get a worse one. Avoid scams. Lawyers have no power over getting you a loan modification. IT IS NOT A LAW FOR FINANCIAL INSTITUTIONS TO GIVE YOU A LOAN MODIFICATION. Also, it is you who have negated the loan agreement. One final thing, YOU DO NOT HAVE TO BE LATE TO GET HELP. DO NOT PURPOSELY FALL BACK ON PAYMENTS AS IT IS AGAINST THE LAW. NOT EVERYONE WILL QUALIFY FOR THE MHA (event though it is a joke). I’m disabled from an auto accident in 2007, and my income is 25% of what it used to be. My neighbor’s plumber mistakenly cut my pressurized sewer line, causing a landslide, which local authorities have ordered me to fix at a cost exceeding $1 million. Our County Assessor devalued my property from $831,000 to $19,000 due to the landslide. I too faxed everything to Indymac on 12/03/09, but they claim it is not imaged for the representatives to view on their computers as of 01/26/10. My property tax is now $461/year, but Indymac continues to collect $566/month. I may walk and let them eat the loan, the property is worthless, and they’re impossibe to deal with.

USELESS TIP FROM HOPE. Go to HUD? what a joke, that’s the first thing I did before I got a lawyer and they said sorry, we can’t help you. Too bad so sad. Been there done that. Haven’t you read these blogs? People have been inevitably unemployed due to the economy, disabilities and what not and can’t make their payments! How is that cancelling the agreement with the bank? and I would like for you to cite whatever LAW you claim that falling back on your payments is against. You are reaching out to your lender for help based on the Obama plan for loan modifications. It is not a law for financial institutions to give a loan modification, but they readily accepted the bail out money that WE, the tax payers, forked out and then they turned around and #$%^ us in the you know what. Now, we’re talking about Indymac here. I know there are banks out there who ARE modifying loans. We are the unfortunate ones that had loans serviced by Indymac Bank.

I was in the same situation as most….sent in papers and heard nothing back. BUT, finally I did receive a modification. It was lower but they actually did not go off the new numbers (lower income) that I had sent him. There was nothing I could do. I’m hoping for a second modification and they said I can only do it every 6 months so I am looking at that. The best thing is to keep your information updated on their website. The funny thing is I called a few days before my modification packet came in the mail and they said they still didn’t have anything documented so apparently one hand doesn’t know what the other is doing. I was finally served and was grateful for the reduction but not happy that none of my current information was reviewed or considered. Good luck to everyone!!!!

We got burned by indymac! They will lie cheat & steal your home! We fought for a mod for 9 months. Submitted docs five times to have them sell our house! They never gave us the time of day! They always said ‘It’s in review’. Never once were they helpful for any reason. Do not fall for the game they play! They will take your house from you with out thinking twice about it! We jumped through all the hoops & did everything asked of us to make it happen! Never did they care or try to make anything works for us!
They got your money from the ‘Bailout’. They will take any money they can up until the day your house is sold from under you! All Lies All the Time! NEVER TRUST INDYMAC! They have stolen your tax money from the bail out! They will take your house too! Stop paying NOW! Save your money! Move at the last minute! They don’t care so why should you! They took our house! OWB took over Indymac’s portfolio for 70 cents on the dollar, and the Feds reimburse them for any losses incurred when they provide a loan modification. The sad thing is that homeowners who go to short sale are then asked to pay the deficiency balance, and OWB ends up MAKING money on the whole deal!
It’s no wonder Indymac would rather foreclose than offer loan modifications-one option is a loser and the other is a money maker!
Effective April 5, a new expansion to HAMP takes effect-called HAFA. Home Affordable Foreclosure Alternatives. For those borrowers who do not qualify for a loan modification, a streamlined short sale process under HAFA provides a $1500 move out payment to homeowners, and no way the banks can pursue a deficiency balance judgment.
In addition, lenders now are required to review every loan modification application and respond within 30 days-either approve the borrower and begin the trial modification or deny the borrower and move them to HAFA.
If the homeowner completes the 3 month trial modification, then it will be made permanent automatically. No more trials and then finding out you are denied.
It is more critical than ever to submit an accurate and acceptable loan modification application the first time-you only get one shot to do it right.

I just started a loan modification but now I am convinced just to either stop payments or sell. The screwed me on my loan, the girl was fired the next day but I still had to pay.!! I will never deal with them again.

When the Fed sold Indymac to OWB, they discounted all the loans to 70% of their value, so that means that your loan is owned for a lot less than you owe the bank. Indymac also gets paid to modify loans and reimbursed for any losses, so they can actually profit on a defaulted loan.
Realizing this, it makes sense that Indymac is hesitant to offer loan modifications to borrowers-if they make money on foreclosure then why would they want to help homeowners stay in their homes?
Remember, banks are in business to MAKE money-not lose it, so their first order of business is always what is best for them. Forget about social justice or being advocates for homeowners-not going to happen people!
But, under the HAMP guidelines, if it is cheaper for them to modify than foreclose then they MUST modify. As a borrower, your job is to present your case as accurately and convincingly as possible.
This is where your financial statement comes in and why it is critical to be sure that you have prepared it correctly. There are standard guidelines for approval under Obama’s HAMP-if you can meet those guidelines then you have a good chance of success.
Face it, it’s pretty hard to qualify for something if you don’t know what you are trying to qualify for-do you know the debt ratio requirement and if you fit it? What about Asset Ratio requirement or Imminent Risk of Default criteria? These are mandated approval criteria that you need to meet.

I may finally have an answer on my loan modification from Indymac-after several attempts to submit my application, they told me yesterday that they have everything they need and it looks good and I should be getting something in the mail within 2 weeks. Not sure what that means but I am taking that as a hopeful sign. Does anyone have any advice on what to say to them when they ask me about my income? I am self employed and not really sure exactly what they want-should I explain that my income is way down or will that disqualify me for an Indymac loan modification? Also, they asked for may bank statements so I sent them in but since my business is slow, there was not much in there. Will that help me with Indymac’s guidelines or hurt me?

i just want to give you all a word of relief and hope! Just like most of you, I am in a very
difficult situation, thank God i still have a job, but my income was reduce to were is had
for me to pay my motgage payments. so far Im bless to find a few good people within
IndyMac… Rachael Hoffman is a wonderful person and help me with a lot of the questions i had. i submited for a Loan Modification it took almost a year, but after sending and resending
the documents IndyMac requested. I was fortunate to get a letter stating I was Aproved to enter into a Trial Period Plan!!!!!! they working a deal that is making my headaches a lot less
painful!!
so my adviced to you, is to just keep sending the documents they ask for. and keep
insisting until your request gets a response.. there is Good People working for IndyMac
and im sure you will find one too.

An Indymac loan modification trial period will give you the chance to show the bank that you can afford the new loan payment. Make sure that you pay the modified payments right on time or you can be terminated from the Obama HAMP program.

I have had exactly the same problems dealing with Indymac as everyone above since I started my loan modification process June 09. Been lied too over and over again from Indymac. Fed up with them now. I wanted to keep my home but they are unwilling to help. Does anyone know how long it will take for them to foreclose? I have had several friends stay in their homes for almost a year after they stopped making payments but I am not sure who their lender was.

The more I read today, the angrier I became. My husband and I also have a loan with Indymac. Since the summer of 09′ we’ve been trying to get a modification. We paid HLMC, a company specializing in negotiating our modification to deal with Indymac for us. They are getting nowhere and I can tell from phone conversations that they are frustrated. If HLMC is unsuccessful they owe us about $2000.00. I’m afraid that’s the least of our worries.
My husband and I have poured our hearts and souls into our home and yard.

I have finally given up hope of getting a loan modification after over 1 year of trying to save my home. In Novemeber of 08 I lost my job and fell behind on the loan payments. In February of 09 I was rehired and immediatly began trying to modify my loan. I have filled out and sent over 4 financial packets, two loan modification periods and faxed paystubs and job letters along with spent countless hours on the telephone with one west bank and still have nothing. I MADE MY PAYMENTS ON TIME AND FILLED ALL REQUIRED DOCUMENTATION AND STILL HAVE NO RESOLUTION. I have been “under review” since november when I was denied for “not providing proper documentation” even though i did everything right.
My theory is that Indymac/Onewest is trying to stall. The new investors purchased these mortgages for such a discount that if we all go bad they will make a fortune. They have no interest in helping us and want us to foreclose. My house is $100k upside down and based on what they purchased my mortgage for from the FDIC they will still make a pretty penny when I foreclose. I don’t care about the money…I just want the home my wife and I dreamed about and have the ability and want to pay for it.
I called in again today and heard the same story I have for the past year…no one really tells you anything just generalizes everything. I said when this started that I would do everything I could to stay in my home…but I am giving up…I SURRENDER…TAKE YOUR PROFITS AND KNOW THAT THERE ARE FAMILIES AND DREAMS THAT YOU DESTROY WHEN YOU DO!!!

I really don’t think you should give up on your Indymac loan modification yet. I know it is frustrating but every day I hear from homeowners who are getting the Obama plan and a very low monthly payment. It is critical that you understand the federal formula used to determine if you qualify and then use this very same formula when you prepare your financial statement.
If you just guess at what the requirements are you really don’t stand much of a chance of getting an Indymac loan modification.

I feel better to know that there are so many others out there being royally screwed over by Indy mac. We have been trying for a loan modification for almost 2yrs now..and we keep getting the run around everytime I would call to see what the status of the mod was. I was always told the same thing..”it is still in review” so my mod has been in review for almost 2yrs now..ummm ok. Of course though, we will still continuously get the loan mod packets to fill out and send back. Indy Mac is completely clueless of anything that is going on..I am sure that when they get everyone’s loan mod packets through the mail or fax..they have some teenagers in the back shredding everything so they have no signs of evidence. That just allows them to tell everyone that calls to check on the status of their mods..that they never received anything and they can continue the foreclosure processes faster. They are a waste of space..but you know..don’t give up..keep fighting till you have no other choice but to give up. This is your home you are trying to save, do not let some scum dwellers rob you of that dream. Keep pushing and we need to get a class action lawsuit going..we need to take these idiots down once and for all. I want to see them lose their homes, then they will know how it feels. Thanks.

I have just started this stupid process. I was denied a loan mod in Oct because I had good credit. I was using my ira to supplement all my bills and my mortgage. I filed BK 13 and was never late with Indy,, just got word, yesterday, denied again for a Loan mod, stating the “investor” is not doing them? WTF? I am an underwriter for B of A and none of this makes sense. I want to keep my home of 10 years and I am a victim like everyone else.. It appears, I should stop payments live in my house free for a year and have them boot me out! Short sales seem to take forever, so why wouldn’t i just do that? It looks like since I filed BK, I cannot do a modification anyway,, things are so beyond screwed up!

If you filed a Chapter 13 you can still get a loan modification from Indymac, but you need the court’s approval. If you have not been late on your mortgage, then the Obama plan mandates that you meet an imminent risk of default category. This is actually a mathematical equation based on your net income, debts, assets, etc. It sounds like your financial statement needs to be fine tuned to make sure you fit into the tiny box that determines if you qualify for HAMP.

My loan balance is $196,000 and I have a fixed interest only rate @ 5.5% which expires in 18 months. I would love to get a 30 year loan at a fixed rate with principal & interest payments. However,IndyMac will not even listen. Indy insists in dealing a new loan for the entire 196,000 with $7,600 in closing fees and @ a 5.75% interest rate. Now here is the kicker, the home was originally appraised at $320,000 when it was built in 2005. However, the current appraisal came in at $165,000. We understand that no one in their right mind should over pay for goods & services. it is downright un-American & illegal.WHAT THE HECK ARE WE SUPPOSED TO DO? We are not young bucks anymore.

Yes, the fact is that the banks are making BILLIONS under the federal plans and homeowners are left holding the bag and the tax bill! Something is not right with the loan modification plans as they are now. ALthough almost a million homeowners have been helped with some type of loan workout, the vast majority of loan modification applications are never approved.
Indymac told me that they shredded 30,000 applications in one week because they were incomplete! Those poor homeowners think they are waiting for an answer but their paperwork is gone!!
The only way homeowners have a chance is to learn the program, prepare your paperwork correctly and then call every 3 days! It works-I have hundreds of homeowners who have gotten loan modification using this system, I know its a small number but it’s worth a try.

Well, that is an interesting article about Indymac loan modifications and why they may not be so motivated to help their borrowers. I can personally attest to many loan modification being completed with Indymac-OneWest. Homeowners who used The Complete Loan Modification Guide kit and Software have sent me copies of their completed loan workouts, which I gather to use as examples for other borrowers. So I know that it is possible to get a HAMP loan workout with a 2% rate-I have seen many!
Now, that does not mean that every homeowner will be approved for a HAMP Indymac loan modification-but what I do know is that if you prepare your financial statement correctly and you fit into the federally mandated guidelines, you have a very good chance of approval. Like anything else, the more you know and the better prepared you are the better your results are going to be.
Homeowners need to take responsibility, investigate, learn and prepare – then submit their package to Indymac-that is the best way to work within the system that has been set up.

I have been helping a Vietnamese man since October 2009 and we are getting nowhere, very slowly! We have mailed and faxed numerous packages of documents as requested; obtained copies of all documents as requested; have had telephone conversations with One West and Indy Mac. This guy does not want to fall behind on his payments, he just needs help with lowering his monthly payments. In the last conversation with IndyMac, I was told “we have no idea when you will hear anything”. Isn’t that wonderful?

There are some big changes coming down from the Feds that will affect Indymac loan modifications-the Treasury Dept has had enough of the delays and poor results of this loan workout plans, and are mandating new guidelines and performance critieria.
If you have been trying to get an Indymac loan modification but had no luck, now is the time to not give up but get your application updated, fine tuned and resubmitted for review. The Treasury Dept is saying that they expect to see hundreds of thousands of homeowners offered either a loan modification or a short sale and are demanding that Indymac and other lenders abide by the federal HAMP guidelines.
So, don’t give up just yet-but be certain that you prepare your financial statement correctly so that it proves you fit into the debt ratio and target payment guidelines.

I too have had all the problems that you all have encountered with INDY MAC. I have sent payments to the wrong locations, gotten letters telling me that our TRIAL MODIFICATION payments had not been made, even though I had the receipts to prove it. When you call dont talk to the First line of people, Tell them you need to speak to SUPERVISOR.. There not much better, but I had much better dealings with them. We started the Trial modification in October and made all three payments till december. I waited, and waited, Called and called again, Talked to a lawyer about bankruptcy. I did it all. Finally two weeks ago I called them back, spoke to a supervisor and they told me by the end of the month that my Loan modification papers would be sent via priority mail. Low and behold, They came. Payment went down about 100 a month and we have a 5.5 % interest rate. There is hope out there, I felt down and out as all of you! Just stay on them.

I have been trying to get a loan modification from Indymac Mortgage since September 2008. They placed me in a lower payment from March – May 2009, in which I was able to afford. Then the unhelpful customer service people stated that I needed to pay the full mortgage payment for June. I borrowed money from my friends and family to make the full mortgage payment and after the payment was made, they declined my loan modification. I have been working with other organizations, who have stated that Indymac is very uncooperative in getting modifications completed. And now I am at the point where I have no choice but to file protection to prevent foreclosure. Indymac is extremely uncooperative and makes crazy excuses “investor not doing modifications”. I think this organization is a sham and I am sending information to my state representative to inform them of this organization. I wish everyone the best in getting their modifcation through, but Indymac has a terrible track record in loan modifications.

I just completed my third trial payment April 1, 2010 and I read your comment- quoted below:
admin said-”If the homeowner completes the 3 month trial modification, then it will be made permanent automatically. No more trials and then finding out you are denied.”
Was this implemented April 5,2010? I guess that means we get to keep our house?
Of course Indy-mac/OWB says we have to wait until the end of this month (April-2010) or even make a 4th and a 5th payment until they reach a decision. I wonder if this is against the law or hamp/hafa rules to drag people along like this?

The new regulations for loan modification will be implemented June 1, 2010 and so Indymac will be converting trial modifications into permanent loan workouts once the the 3 trial payments are made.
Regarding your Indymac loan modification, it is hard to say since you began your trial prior to the implementation of the new federal guidelines.
The only thing you can do is to be certain that all your payments are made on time and then stay on top of it-if they ask for something be sure to send it in right away. Call Indymac every few days and insist on the permanent loan modification paperwork.

I keep being told by indymac that they are foreclosing but i should still make payments, why? why would i pay for a house you are going to take. then they cancel the auction randomly, and never tell me why, i think it is cause i told them the house wont sell the basement is flooded and i am not pumping it out. people buying the house will get the truth, and the house wont sell. and i will go to the grave owing you this money. i went to my local representative he said he is swamped. but i did find out that Indy mac doesn’t own my home, and hasn’t for a while, then who am i paying my payments to, supposedly some California conglomerate called one west, oh frolicking great, more run around, and babbling lawyers, you dont scare me, see you in the court room, after the house sells for fifty cents, and i am put in jail and you collect 100 dollars a year. I have been working with Indymac for more than a year now. But, I have never had anyone who had been approve of a loan modification. They will put the buyer to a trial period and asked for a contribution. After they received the papers and the money, they will send the buyer a letter that they have been declined!
I have also been told that they only have the Obama program, if you can’t get approve with that program, you are finish! I wish somebody will tell this bank to wake up and smell the coffee! This bank had cheated a lot of homeowners and they are still doing it, until now!!!

Ok People here is the latest. IndyMac/OneWest has two service centers. One in Michigan and One in Texas. You need to call everyday about 2:00pm and TAPE RECORD your conversation with them. I have found out that you will get two different stories depending on which state you talk to. It also looks like anytime you get a positive answer and notes are made, the notes mysteriously disapear. TAPE RECORD all of your conversations with them, use this as leverage and it can be used as evidence if you bring a case against them. Make sure you get employee names and ID numbers everytime you talk to them. Make notes with date and time also at the time of your conversation. Do not try and re-create your notes as this my hurt you and not help you. I’ll keep you posted.

I have been tring to get my loan modified for 9 months and now they say my paperwork has expired so I need to submit it all again. If they had worked a little faster it would not have expired. I have always paid the mortgage but I guess I have to be late or stop paying before they will do anything. Sylvia

To Bob S,, no matter if you record a conversation or not, you have to have permission to use it in court and notify whoever you are talking to that the conversation is being recorded. Another thing is, a bank can’t just foreclose on a property….. you have to be behind. People, you need to quit trying to depend on something (modification) which is not a guarantee and start being responsible adults and make your payments per the terms of your agreement. Everytime something don’t go your way with credit cards,car loans or mortgages, you people seem to think… LAWSUIT. If you have the money to pay for an attorney, then you should have the money to pay your bills. When Obama announced the HAMP program, he said that not everyone would qualify. The modification isn’t an alternative to a refi, or used because you don’t like the payment you have. If your payment is less then 31% of your gross income then YOU DON’T QUALIFY FOR HAMP!!!!! I work for a 3rd party agency which help people with trying to get a mod. i can’t say how many times I have tried to help people which lied and said they only made a certain amount and really made more. That is so scum of people to do this, which in turn can slow the process for people that really need help and have a lower income amount.—Nicole—

I HAVE BEEN OUT OF WORK SINCE MAY 2008 DUE 2 NECK SURGERY..I SUBMITTED LOAN MODIFICATION FORMS,TO INDY MAC. I CALLED EVERY DAY, BUT THEN NEEDED ANOTHER NECK SURGERY/ARM SURGERY. I CALLED WHEN I GOT HOME FROM THE HOSPITAL AND WAS ALSO TOLD TIME EXPIRED, AND NEEDED TO RESUBMIT I RESUBMITTED FORMS AGAIN.. I CALL EVERY OTHER DAY, AND AM TOLD THEY ARE BEING REVIEWED…. I WAS JUST TOLD NEEDED 3RD NECK SURGERY, AND AM WAITING TILL I GET THIS RESOLVED. I HAVE USED ALL MY 401 K., SAVINGS… I.HAVE GOOD (OR HAD) CREDIT, NEVER BEEN LATE ON MY PMT, BUT I HAVE REACHED THE POINT I CAN NOT DO ANYMORE WITH OUT HELP. I HAVE COMPLETED …”THE COMPLETE PACKAGE” HAD IT LOOKED OVER BY BROKER AND ATTORNEY (RELATIVE) I HOPE AND PRAY I AM ONE OF THE BORROWERS WHO GET HELP.ALONG WITH ALL THE REST OF THE PEOPLE WHO ARE GOING THRU HARD TIMES..SOOOOO WE CAN GO FORWARD, AND LIVE OUR AMERICAN DREAM..WE DID NOT ASK FOR HARD TIMES IN OUR LIFE, AND TRULY BELEIVE INDY MAC ALONG WITH OTHER BANKS SHOULD TAKE THIS RESPONSIBILITY ONE EMPLOYEE AT A TIME…JUST NOT BE TOLD WHAT TO SAY ON THE PHONE!!! they gave me a modification plan but they dont give you anything instead they triple your debt
at the end they just make you pay for more years. in my case, i figured a total of 40 years.
theyre basically not giving you anything for free. Watch out!

I am looking to file a class action lawsuit against IndyMac and after reading these postings it is apparent there are many who would be interested. They are continuing to commit fraud against the homeowners trying to modify their loans, by denying they ever received any paperwork, giving false statements over the phone (the conversations should all be recorded), returning checks stating they are incorrect so the applicant would not be compliant with the trial loan modification process, etc. etc. I am filing a complaint with the good Jerry Brown, our attorney general, and with the Dept. of Corporations of California. This behavior has to stop!!!!! They just put a sale date on my property for the 7th of July without any notice. I am sick of it and I’M NOT GOING TO TAKE IT ANYMORE!!!!!!! Will you join me? The Indymac Bank loan modification process has been a nightmare for hundreds of thousands of homeowners who are desperately trying to save their home. Why is it so difficult to get help when the federal programs have been running for over 1 1/2 now? HAMP was launched early last year with the goal of helping over 5 million homeowners with home retention. However, only a small percentage of Indymac homeowners have received a permanent loan modification.

Yes IndyMac makes excuses after excuses say anything they can come up with just so they don’t have to help you! Also I sent in all required documents from the beginning they even confirmed it to me! I faxed my total package 3 times in a row with my loan number on each one. 30 days turned into 60 and so on. i have updated my documents over and over. Then I was denied for lack of providing bank statements that I was sending in every week??? They are a bank they do know what a bank statement is! The representative even confirmed that that information was untrue and not my fault! She verified herself that they have had the correct documents all the time! She stated that she put in for and appeal/review of that decision but unfortunately the process will not start until 30 days from that date. 30 days 60 days is all they keep saying! I even explained how I have received threat of foreclosure but unfortunately there is nothing she can do! I contacted them immediately when in trouble financially, I did everything I could, I even spoke with an agent who in so many words told me that since the man assigned to my modification isn’t retuning any calls or emails from me then he just doesn’t want to talk to me???? Excuse after excuse, lie after lie! They don’t want to help anyone! I have interest only first 10 years fixed 30 year loan with no arm, which my HOPE counselor told me makes no sense and doesn’t exist! I guess that’s why they don’t want to modify me because they pocket the first 10 years worth of payments off top! Gorilla’s!

i been in process for well over 2 years and have not had any resolution s of yet.I completed a 3 moth Hamp Trial Payment Plan and waiting for a final loan modification. Now the assert that the requested documents were not received in a timely manner and mail me a dined letter .I’m disputing this dined letter and today I try to make a payment over the phone and they refuse to take my trial payment and offer me the short sale ,foreclosure or deed in lieu., I hire a person and pay $5,000k already, to do my modification and his is asking me to be calm, ..I don’t know what to do, in times i think to my self…should I hire an attorney?..should I write directly to the CEO? , but the person who is doing my loan do not want me to go over his head, he is telling me that i may ruin my modification, for me to wait until he got an ans.from the person he was dealing with in Indy Mac.

we have been trying to get a loan mod for approximately 6 to 7 months and to this day all indymac is saying we are reviewing your application. we have sent, faxed, called and everything else they required and we still have gotten zero answers. they even had a guy post on our door a trustee sale date that made my wife almost have a heart attack. them we had a guy who looked like a gang member come over our house and started to take pictures. i was so pissed off that i wanted to called them-up and give them a piece of my mind. also, they had set-up a sale date for our house for jan. 3, 2011. it makes me sick how greedy these banks are and the people who work for them are heartless assholes. i am all for the class action lawsuit, screw these bastard!

I’m in the same boat as everyone else, been trying for a year for loan modification,sent documentation in 5 times they say i’m missing something everytime.so much for trying to help us.Class action lawsuit sounds good to me.

I too Have been trying to obtain a modification for over a year and received a run around and then I paid a law firm to handle my case,And have been on a constant wild goose chase since they started handling my case 8 months ago. each time docs were requested they were sent promptly and each time you call and follow up they give you a BS story that it is under review and call on a latter date,and when you do you are made to start back at square one. I am so frustrated. had a sale date for last week and got a postponement on it. I dont want to loose my house .I am so afraid. Has anyone made payments after sale date and gotten back on track?? And if so, how did you do it.Did you go to the bank in Pasadena and make a payment or how does it work. I too wrote to president Obama but they just don”t seem to care. INDYMAC seems to be an EVIL SUPER POWER that even the president cant shake. They are LYING, DECEIVING and CHEATING US OUT OF OUR HOMES OPENLY and nobody even the president cant seem to lift a finger to stop them.Where are you Mr.Obama when there are so many of us desperately in need of an intervention??? Well if this trend of foreclosing on homes continue theres no chance that our economy would ever recover. If there is ever a group forming to do anything to wipe INDYMAC out of the face of this planet…. Count me in.

My home dropped from 575,000 to 339,000. Obama and our bought and paid for congress ran to the aid of the banks and wall street. Poulson secured an 800,000,000 billion dollar loan with the signing of a document only 3 pages in length. We have to fill out reams of documents promising our new born and still can,t secure a loan modification on our homes. These thieves should be in prison but our bought and paid for gov,t has refused to pursue these C.E.OS there by bring a law suit against these people extremely difficult if not impossible.
I was not only foreclosed on but IndyMac bank repossed my home. These crooked lawyers from Florida,who indicate very stongly that they can secure a loan modification, turn out to be frauds.

i’ve been trying to modify my loan for about 2 years, i have sent my paperwork to indymac over and over to different fax #( everytime i call they give a differnt #) i am getting frustrated my next step is to take this to the media!.

My 78 year old mother has her mortgage with Indy Mac, which is interest only. The loan amt will be increased in 2012, since early 2010 she has been trying to get her loan modified. She applied 4X and each time she was rejected. All rejections were due to the fact Indy Mac requested additional information, but they did not give her enough time to provide the detail. Last denial is they requested two bank statements, they need March and April. March was sent but this is only the 4th of April. In addition it is very difficult to speak to a Manager.

I HAVE APPLIED FOR A REMODICATION LOAN TOO AND RECEIVED THE RUN AROUND. FLOOD YOUR STATE ATTORNEY GENERAL OFFICE WITH YOUR COMPLAINTS. HIS NAME IS ERIC SCHNEIDERMAN. HE HAS BEEN ADVOCATING FOR THE HOMEOWNERS IS PLEDGES TO GO AFTER THESE BANKS WHO ARE WRONGFULL TAKING OUR HOMES AWAY FROM US. I first sent IndyMac the documents back in mid-2009 when I first began getting behind. I kept calling to confirm that they were processing my modification request, and they said to just wait. Finally several months later, they told me that they never received my package. I guess they lost it along with all the others they have been losing.
I used a company later that year to re-submit documents and this time they got them but now claim that my mortgage doesn’t qualify for a modification. Something about the mortgage guarantor not participating in the HAMP program.
We bailed out IndyMac – how can they do this to us?
Has anyone had any success with legal action? I don’t want to pay a fortune to attorneys and find that they do nothing but I keep getting notices in the mail from attorneys who claim that they can get results from IndyMac.

Thank you, I hope the information I provide on loan modification guidelines and procedures helps homeowners get a lower mortgage payment and save their home from foreclosure.
The HAMP loan mod program has helped over 1 million borrowers, but sadly only about 25% of people who need help get it. Once you understand how to complete the Wells Fargo loan mod RMA form, then you will have a much better chance of getting approved.

The FDIC has given One West Bank a free trip to Vegas with the downside risk covered by the taxpayers.
This type of collusion with the government and some banks has helped to put me in a grave situation having to go to the Hawaii Supreme Court just to be able to stay in my house. Why?
In 2009 I fell Ill and am disabled with a long term disability insurance policy. I have been to the Mayo Cinic in Rotchester Minnesota twice in the last two years ( I live in Hawaii). When I was on short term disability I called One West Bank because I’d heard of the HAMP ( Home Affordable Modification Program). I was told by One West to go 90 days delinquent then I would qualify ( I have since heard that that is when they can put the FDIC on the hook for my loan and the credit default kicks in?). I was invited to apply and was granted a modification. It stated that as long as I made my thee trial payments on time I would be granted modification.
The mod lowered my payment by about $350. I was sure not to mess this opportunity up I even paid by cashiers check. None the less on the 20th of August 2 2/3rds of the way through and always being early with my payment I received a letter along with my last payment returned stating that the amount paid which was exactly what was asked of me was not the outstanding balance. After getting nowhere and being told I could re-apply I was served foreclosure papers soon after. I was devastated. My 8 year old daughter has never known another house and my wife and I had worked and tirelessly on it ourselves to make it our home.
I started to look for the best attorney in Hawaii for my problem, Gary Dubin’s name kept coming up. I heard he was not the cheapest but the best. I went to see him and he looked over my situation and told me my case was very strong. I retained him with a fairly large retainer. His very capable associate attorney Frederick Arensmeyer found out that my home had been sold to Fannie Mae on the 10th of August while I was current on my mortgage under One West’s terms. The price? $10 This is a clear case of fraud in the inducement and the attempt to take advantage of someone in distress. I am sure my health has become worse in no part because of the stress, lack of sleep and mental anguish this fraudulent bank has put me through. Never knowing if the ax is going to fall is a sure way of taking “the American Dream” and turning it to a nightmare. One West has been committing this modification fraud on a HUGE scale. The sweet heart deal that One West Scored from this administration with our Bail-Out money and the FDIC have made it a much better deal for the bank to screw the people rather than help. Please see the link below for a very brief explanation of this. HAMP is mostly a front when it comes to One West. One need only to Google “modification fraud One West Bank” and you will find scores of other people that have had similar dealings but perhaps not as outstanding council or none at all.
On top of this the Lahaina District Court has approved eviction orders and only took five minutes to review 300 pages of material. I am forced to go to the Hawaii Supreme Court to file an Emergency Petiton for a Writ of Mandanumus to the so-called Honorable Bliane Kobayashi. Without proper jurisdiction this Distict Court Judge would rather throw me on the street than and allow obvious interstate fraud by a bailed out institution to go unchecked. He would rather side with the out of state bank than a long term resident that has be in Hawaii 15 years and has always been an upstanding citizen having great respect for the law. I will suffer irreparable harm without the facts ever being heard should I be evicted. Has this Judge ever heard of the 5th amendment?
Why would a judge be so one-sided and refuse to follow the same type of respect for the higher courts here in Hawaii? Are judges pension funds and the mutual funds that they contain a possible reason? In the face of all the animus towards banks for taking our money in the form of Bail-Outs then not lending or lending to foreign banks, robo signing and many other scandals why does this judge side with the institutions that seem to not respect the law? My case is fraud pure and simple.

A false representation of a matter of fact—whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed—that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.

Indymac has one of the worst reputations for helping homeowners with loan modifications. When the FDIC took them over they received a sweet deal and OWB took over the portfolio for cents on the dollar-all on the promise to reach to their struggling homeowners and offer loan mod assistance. Well three years later the stats on completed loan workouts are dismally low. It seems that the Indymac loan modification program was not structured so that it was more attractive to Indymac than foreclosing-nor more cost effective for the banks bottom line. Only homeowners who have a really good understanding of EXACTLY how to prepare their loan mod RMA form has any chance at all of getting approved-and you have to have nerves of steel and the persistence of a bulldog to get any results.

My question is: “Is anyone ready to sign a consumer petition against IndyMac Bank (One West) so our voices in numbers can make a difference perhaps by filing a federal complaint with the U.S. government asking for an investigation and resolution with these issues of the bank’s refusal to do “honest” business with its loan holders who in good faith are trying to keep their homes without foreclosure (which adds more economic decline to the U.S. economy) taking place as is apparent way this bank seems to be steering everyone.
The only other reason for their behavior is because they stand to profit on both ends: 1) by the homeowners still struggling to pay and keep their homes and 2) by the U.S. government paying them off whether the homeowner pay or not (they do the foreclosure so Freddie Mac/Fannie Mae/HUD pays off these debts for them anyways)-so they are always a winner one way or the other, with homeowners being the primary loosers home wise and credit wise.
We know God is still in control and why prayers are that He will definitely deal with these crooks as only He can do so. If you agree respond with comments here.
